housepaint.ai is a web-based application that provides AI-powered tools for visualizing paint colors on homes and buildings. Our Service includes:

• AI-powered surface detection and masking for architectural elements
• Color visualization using manufacturer-accurate paint colors from Sherwin-Williams, Behr, and PPG
• Image editing tools for precise adjustments and refinements
• Cloud storage for your projects and edited images
• Sharing capabilities to collaborate with others
• A credit-based system for accessing AI processing features

Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

You must be at least 13 years old to create an account. If you are under 18, you represent that you have permission from a parent or guardian to use the Service.

Credits and Payment Terms

Credit System

Our Service operates on a credit-based system:

• New users receive 10 free credits upon account creation
• Credits are consumed when using AI-powered features such as automatic masking and color application
• Additional credits can be purchased through our payment system
• Credits do not expire but are non-refundable once purchased
• Credit usage is deducted in real-time when features are used

Payments

All payments are processed securely through Stripe, our third-party payment processor:

• Prices are displayed in USD and may be subject to applicable taxes
• Payment must be made at the time of credit purchase
• We do not store your payment card information on our servers
• All purchases are final and non-refundable except as required by law

User Content

Your Ownership Rights

You retain all ownership rights to the images and content you upload to the Service ("Your Content"). By uploading Your Content, you grant us a limited license to:

• Store, process, and display Your Content to provide the Service
• Use AI and machine learning models to analyze and process Your Content
• Create derivative works (such as color variations and edits) as directed by you
• Display Your Content to users you choose to share with

Content Restrictions

You agree not to upload or share content that:

• Violates any law or infringes on the rights of others
• Contains malicious code, viruses, or harmful materials
• Is defamatory, obscene, threatening, or harassing
• Violates any third party's intellectual property or privacy rights
• Contains personally identifiable information of others without consent

Intellectual Property

Paint color names, codes, and associated trademarks are the property of their respective manufacturers (Sherwin-Williams, Behr, PPG). We provide these for reference purposes only.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that could damage, disable, or impair its functionality
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to transmit spam or unsolicited communications
• Interfere with other users' use and enjoyment of the Service
• Circumvent or attempt to circumvent the credit system or payment mechanisms
• Share account credentials or allow others to use your account
• Use the Service for any commercial resale or redistribution without permission

Disclaimers and Limitations

Color Accuracy Disclaimer

While we strive to provide accurate color representations, actual paint colors may vary due to factors including monitor calibration, lighting conditions, surface materials, and paint application. The visualizations provided by our Service are approximations intended for planning purposes only. We recommend obtaining physical paint samples and testing them on your actual surfaces before making final decisions.

Service Availability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

Limitation of Liability

To the maximum extent permitted by law, housepaint.ai and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Indemnification

You agree to indemnify and hold harmless housepaint.ai, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe:

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease, and we may delete your account and data. Unused credits are forfeited upon account termination.

Any disputes arising from these Terms or your use of the Service will be governed by the laws of the jurisdiction in which housepaint.ai operates, without regard to conflict of law principles. You agree to first attempt to resolve any disputes informally by contacting us. If informal resolution is not successful, disputes will be resolved through binding arbitration or in the courts of the applicable jurisdiction.

Changes to Terms

We may update these Terms from time to time. Material changes will be notified through the Service or via email. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may terminate your account.

Severability
